1. General Overview

Urbanyx is an e-commerce platform specialising in limited-drop streetwear, apparel, and accessories, operated from India. We offer users the ability to browse, wishlist, and purchase products through our online store. Products are sold subject to stock availability, which is strictly enforced at checkout.

2. Eligibility

You must be at least 18 years of age to use our Service or make purchases on our platform. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts found to be operated by minors.

3. Account Registration and Security

• Account Creation: To use certain features — such as adding items to a cart, creating a wishlist, or making purchases — you must register with a valid email address.
• Email Verification: All accounts must be verified via an OTP sent to your registered email before they become active.
• Account Information: You agree to provide accurate, current, and complete information during registration and to keep it updated.
• Account Security: You are solely responsible for safeguarding your password and all activities under your account. Do not share your credentials with any third party.
• Lockout Policy: Your account will be temporarily locked for 24 hours after 5 consecutive failed login attempts. An email notification will be sent when a lockout occurs.
• One Account Per Person: Creating multiple accounts for the same individual is prohibited and may result in suspension of all associated accounts.

4. Product Availability and Orders

• Limited Drops: Our products are often released in limited quantities ("drops"). Browsing or adding a product to your cart does not reserve the item or guarantee its availability.
• Stock Validation: Product stock is strictly verified at checkout and payment. An order is only confirmed once payment is successfully processed and stock is officially decremented. If an item goes out of stock during this process, an automatic refund will be issued.
• Order Confirmation: You will receive an order confirmation email upon successful payment. This email constitutes our acceptance of your order.
• Order Cancellation by Urbanyx: We reserve the right to cancel any order for reasons including inventory errors, suspected fraud, payment issues, or inaccurate pricing. A full refund will be processed in all such cases.
• Accuracy of Product Information: We make every effort to display product descriptions and images accurately. We reserve the right to correct any errors and update product information at any time without prior notice.

5. Pricing and Payments

• Currency: All prices are listed in Indian Rupees (INR). We reserve the right to modify prices at any time without prior notice.
• Final Price: The final price, including applicable discounts and shipping fees, is calculated server-side at checkout and is binding.
• Discounts & Promotions: Discounted prices apply only during specified promotional periods. Discount codes cannot be combined unless explicitly stated.
• Payment Processing: Payments are securely processed through Razorpay. Urbanyx does not store your full credit card, debit card, or bank account information on our servers.
• Payment Verification: All transactions are verified server-side using HMAC-SHA256 cryptographic signatures. Any attempt to tamper with payment amounts will result in automatic order rejection and a refund of the tampered payment.
• Failed Transactions: Urbanyx is not responsible for payment failures caused by your bank, card issuer, or payment network.

6. Shipping and Delivery

• Shipping Partner: We use Shree Mahavir Courier as our primary logistics partner for domestic deliveries.
• Shipping Fees: Shipping fees are calculated at checkout. Orders above ₹2,000 qualify for free shipping. This threshold may change at Urbanyx's discretion.
• Tracking: Upon dispatch, you will receive an email with your tracking ID and a link to the Shree Mahavir Courier tracking page.
• Delivery Timelines: Estimated delivery timelines are indicative and not guaranteed. Urbanyx is not responsible for delays caused by third-party logistics, weather, or events beyond our reasonable control.
• Delivery Address: You are responsible for providing a complete and accurate delivery address. Urbanyx is not liable for non-delivery or misdelivery due to an inaccurate address.
• Delivery Jurisdiction: We currently ship within India only.

7. Returns and Refunds

• Return Window: Delivered orders are eligible for return within 7 days of the delivery date. After this window, returns are not accepted.
• Return Conditions: Items must be returned in their original, unworn condition with all tags and packaging intact.
• Return Process: Initiate a return via "Request Return" under "My Orders" in your account. All requests are subject to admin review and approval.
• Refund Processing: Approved refunds will be processed back to the original payment method via Razorpay. Processing typically takes 5–10 business days.
• Non-Returnable Items: Sale items, final-sale items, and items that have been worn, washed, or damaged by the customer are not eligible for return.
• Order Cancellation by Customer: Orders cannot be cancelled once payment is successfully completed, as order processing begins immediately.

8. Prohibited Conduct

You agree not to:

• Use our Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to circumvent any security measure, including rate limiting, HMAC signature verification, stock validation, or authentication systems.
• Use automated tools (bots, scrapers, scripts) to access, purchase, or monitor the Service without our express written permission.
• Create accounts under false identities or impersonate any other person.
• Engage in any conduct that could overload, disrupt, or impair our servers or infrastructure.
• Attempt to access any administrative areas or data that you are not authorised to access.

Violation of these prohibitions may result in immediate termination of your account and, where applicable, legal action.

9. Intellectual Property

All content on the Urbanyx website — including text, graphics, logos, product images, designs, and software — is the property of Urbanyx or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any of our content without express written permission from Urbanyx.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Urbanyx shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

1. Your access to or use of, or inability to access or use, the Service.
2. Unauthorized access to our servers and/or any personal information stored therein.
3. Delays or failures in delivery caused by third-party logistics partners.
4. Payment failures caused by your bank, card issuer, or Razorpay.
5. Loss of data due to events beyond our reasonable control.

Our total aggregate liability for any claim shall not exceed the total amount you paid to Urbanyx in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Urbanyx, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to your violation of these Terms or your misuse of the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute shall be subject to the following resolution process:

1. Informal Resolution: Contact us at support@urbanyx.store with a written description of your complaint. We will attempt to resolve it within 30 days.
2. Jurisdiction: If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where feasible, by sending an email notification to your registered address. Your continued use of the Service following any change constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Urbanyx regarding your use of the Service and supersede all prior agreements and understandings.
